Area Police Reports


NORTH HARMONY – Michael J. Miller, of Salamanca was charged Tuesday with criminal sale of untaxed cigarettes and criminal tax fraud. At approximately 9:10 a.m., Miller was stopped for speeding after passing a marked patrol vehicle on Interstate 86 in North Harmony. During the traffic stop, a full case of Seneca brand cigarettes was observed sitting on the passenger’s side seat of Miller’s vehicle. Investigation revealed that Miller was illegally transporting the cigarettes with no New York State tax stamps or paperwork. He will appear in North Harmony Court at a later date.


Lindsay L. Ristau, 33, was charged on May 24 with driving while intoxicated, aggravated DWI with blood alcohol content more than .18 percent, consumption of alcohol in a motor vehicle and failing to stop at a stop sign. At approximately 3:58 a.m., police reported to a vehicle accident and determined that the driver – Ristau – was intoxicated.


Timothy J. Banach, 55, of Cassadaga and Michael W. Foster, 50, of Cassadaga were charged on May 23 with petit larceny and sixth-degree conspiracy. Police responded to Wegmans after the above subjects walked out of the store without paying for $501.94 worth of groceries. A store employee confronted the men and recovered the property. The men fled, but were later located. They will appear in Ellicott Court at a later date.
