Duo Charged Following Assault Of City Man

A 58-year-old man suffered a broken hip after allegedly being assaulted by two local men early Friday morning.

Robert C. Ruper, 45, of Jamestown, and James M. Miller, 25, of Ashville were both charged with second-degree robbery, third-degree assault, tampering with physical evidence and trespassing after the incident, which occurred near the railroad tracks south of Center Street near Crane Street shortly after 3 a.m.

Police responded to the area to assist emergency medical services with the injured 58-year-old man. While approaching the scene, officers observed Miller throw a small amount of cash and a lighter on the side of the tracks. As officers escorted Miller to the injured subject, they encountered Ruper, who was also at the scene. Further investigation revealed that the 58-year-old had been tackled to the ground and had suffered a broken hip.

The cash that was thrown on the ground was found to be stolen property that Miller and Ruper had taken from the male victim.

The 58-year-old victim was transported to WCA Hospital to receive immediate medical attention.

Miller and Ruper were taken to Jamestown City Jail where they are currently awaiting arraignment.
