JAMESTOWN POLICE DEPARTMENT
Donathan L. Alston, 42, of Jamestown was charged Tuesday with open consumption and criminal impersonation. At approximately 8:37 a.m., an officer observed a male walking down the sidewalk near the area of East Second and Bowen streets with an open container of alcohol hidden in his coat. The male gave officers a false name, attempting to hide his true identity. He was transported to city jail without incident.
LAKEWOOD-BUSTI POLICE DEPARTMENT
A 16-year-old female was charged Tuesday with petit larceny. It is alleged that the female entered the Wal-Mart in Lakewood and selected several items of clothing valuing $143.30. She exited the store without paying for them. She was issued an appearance ticket and will appear in Busti Court at a later date.
CATTARAUGUS COUNTY SHERIFF’S OFFICE
SALAMANCA – Kirby J. Ferguson, 38, of Salamanca was charged Friday on a Family Court warrant. Ferguson was arraigned in Coldspring Court and remanded to the county jail in lieu of $3,500 bail. He is due back in Family Court at a later date.
LEON – Robert A. Wyatt, 40, of Cherry Creek was charged Thursday with driving while intoxicated, aggravated DWI with blood alcohol content of .18 percent or greater and failure to keep right after being stopped on County Road 6 at approximately 12:02 a.m. He was processed and released on tickets. He is due back in Leon Court at a later date.
DAYTON – Franklin K. Nephew, 80, of Versailles was charged Saturday with felony driving while intoxicated with blood alcohol content of .08 percent or greater, felony DWI, first-degree aggravated unlicensed operation, operating without an interlock, speed not reasonable, leaving the scene of an accident, failure to maintain lane and consumption of alcohol in a motor vehicle. At approximately 11:46 p.m., deputies responded to a call of a truck in a ditch along Route 62. A passerby provided deputies information that led to the finding of Nephew, who had left the scene. Investigation determined that Nephew was traveling too fast when he lost control of his vehicle. There were open beer cans inside the truck. His license was found to be revoked from a previous DWI conviction. He was arraigned where his bail was set at $500. He is due back in Dayton Court at a later date.
ELLICOTTVILLE – Cadince M. Lynn, 21 of Ellicottville was charged Sunday with failure to yield right of way while entering traffic, open container of alcohol in motor vehicle, refusing a breath test, driving while intoxicated, driving with blood alcohol content of .08 percent or greater, unlawful possession of marijuana and seventh-degree criminal possession of a controlled substance after a traffic stop. A pat down search found that Lynn was in possession of marijuana and cocaine. She was released on her tickets and will appear in Ellicottville Court on May 6 at 6 p.m.
NEW YORK STATE POLICE
GERRY – Joshua P. Mleczko, 19, of Dunkirk was charged Monday with unlawful possession of marijuana. Following a traffic stop on Route 60, troopers observed Mleczko’s vehicle driving down the shoulder of the road. A strong odor of marijuana emanated from the vehicle and Mleczko was found to be in possession of marijuana. He was issued a traffic ticket and will appear in Gerry Court at a later date.
